Have you received a traffic fine or had your driving license suspended and think the measure is unjustified? Here are the steps to challenge it:
Verify the legality of the ticket
According to Government Ordinance No. 2/2001 on the legal regime of contraventions, the ticket must contain certain mandatory information, and the absence of some of this information may constitute grounds for annulment. The mandatory elements include:
- the name and surname of the official who established the infringement;
- full name of the offender;
- the personal identification number of the offender who is a natural person or the name and registered office of the legal person;
- the act committed and the date on which it was committed;
- signature of the investigating officer.
Therefore, the absence of one of these entries renders the minute of contravention null and void, and it may also be established ex officio.
Gathering evidence
In order to support the infringement complaint, it is necessary to submit relevant evidence to demonstrate the unjustified nature of the sanction. This may be, for example, photographs or video recordings, witness statements or technical documents.
Filing the complaint
A complaint may be lodged against the statement of offense and the imposition of the sanction within 15 days from the date of the handing over or communication it.
The complaint shall be lodged either with the court in whose district the contravention was committed or with the court within whose territorial radius the offender is domiciled or domiciled.
If the fine has not already been paid, payment of the fine may be suspended during the proceedings. Also, if the penalty imposed was the suspension of your license, you can ask the court to suspend the enforcement of this measure pending the final outcome of the case.
