What are hidden defects?

Hidden defects are serious issues that:

  • existed at the time of purchase;
  • could not be easily discovered through a regular inspection;
  • affect the safety, functionality, or value of the property.

Examples: Leaks, structural problems, mold, faulty installations.

Example from practice: A family discovered foundation cracks 3 months after purchasing a house. They won in court a 20% refund of the house price.

According to the Civil Code (articles 1707–1710), the seller is liable for hidden defects, even if they were not aware of them and the right to a warranty against hidden defects is protected by law.

What is the time limit for action?

The general statute of limitations is 3 years (there may be exceptions and special cases).

If the defect concerns:

  1. Common goods or works (other than buildings):
    • The limitation period starts 1 year after delivery/reception, or
    • From the date the defect was discovered. (if it appeared earlier)
  2. Constructions (e.g., houses, apartments):
    • The limitation period starts 3 years after delivery/reception, or
    • From the date the defect was discovered (if identified earlier).
  3. Routine repairs:
    • The limitation period is 1 month (for common goods/works);
    • 3 months (for construction works).

What can you request?

  • Repair of the defects (if feasible);
  • Replacement of the item with a defect-free one;
  • Reduction of the price paid;
  • Annulment of the sale (termination of the contract and recovery of your money);
  • Damages , if the seller acted in bad faith.

Recommendations:

  • Document everything — take photos, videos, and obtain technical reports;
  • Send a written notice to the seller;
  • Consult a specialized lawyer — every case is different and may require expert input.
